Terms of service

BUSTDOWNTIMEPIECE — TERMS OF SERVICE

Effective date: 08/22/2026

These Terms govern purchases and use of https://bustdowntimepiece.store/ operated by [legal business name], doing business as BUSTDOWNTIMEPIECE (“we,” “us,” or “our”). By checking the acceptance box at checkout or otherwise expressly accepting these Terms, you agree to them. Our Shipping, Return, and Privacy Policies are available through the links provided on our website. Order-specific terms agreed to in writing control if they conflict with general product or production terms below. Mandatory legal rights always apply.

1. Eligibility and order acceptance

You must be at least 18 or the legal age of majority where you live to place an order. You agree to provide accurate contact, billing, sizing, and delivery information and to use an authorized payment method.

An automated order receipt acknowledges receipt of your request; it does not by itself constitute acceptance. We may decline an order because of suspected fraud, unavailable materials, an obvious pricing error, or a design we cannot reasonably produce. If we decline an order, we will promptly refund payments for that order. Once accepted, an order is subject to these Terms and its written specifications.

2. Product descriptions and jewelry materials

The product listing and accepted order specifications identify the metal, purity, stone type, stone quality, dimensions, and any included grading report. Natural diamonds, laboratory-grown diamonds, moissanite, and other gemstones are distinct products and will be identified accordingly. Plating, treatments, and special care requirements will be disclosed where applicable.

Photographs, videos, renders, and CAD previews may show lighting effects or enlarged details. Display colors and apparent scale can differ from the finished piece. Renderings illustrate the approved design; they do not replace written specifications. Handmade pieces may have minor finishing variations within expressly disclosed tolerances. Any material change to the approved design, metal, stone type, or agreed specifications requires your written approval. A tolerance does not excuse a defect or material misdescription.

Weights, dimensions, and carat totals are approximate only when expressly identified as estimates. We do not guarantee resale value, investment returns, or an appraisal value unless separately agreed in writing.

3. Custom designs and approval

Custom work includes made-to-order, personalized, engraved, specially sized, and customer-requested pieces. Before production, you are responsible for checking the proposed spelling, initials, names, sizes, dimensions, stone selections, metal selections, chain clearance, and other details submitted for approval.

Written approval by email, an order portal, or another recorded method authorizes production of the approved design. Silence is not design approval. We are not responsible for errors in customer-supplied details that you expressly approved and that we accurately reproduced. This does not excuse our own production errors.

Change requests after approval require our written acceptance and may increase the price and production time. We will disclose additional charges for approval before performing the changed work. We may decline changes once materials have been ordered or production has begun.

4. Payments, deposits, and balances

Prices and required payments are stated in your checkout or written quote. Quotes expire on the date stated in the quote; after expiration, a new quote may reflect material prices. We will not increase an accepted order price without your agreement.

Any design fee, deposit, and payment schedule will be disclosed before payment. A separately disclosed design fee is earned as the agreed design services are performed. Custom deposits are applied toward the order total. Where legally permitted, if you voluntarily cancel a custom order, we may retain the reasonable, documented portion covering completed work and nonrecoverable materials or commitments, up to the amount paid. Any remaining amount will be refunded. No deposit term limits a refund required by law or arising from our failure to fulfill the order.

Unless your written payment plan says otherwise, the remaining balance is due before shipment. We may pause work or withhold shipment for overdue payments, subject to applicable law. We will provide written notice and a reasonable opportunity to resolve unpaid balances before cancelling an order. We do not automatically forfeit all payments because a customer becomes unresponsive.

Applicable taxes, shipping charges, and any known additional fees are disclosed before checkout. International customers are responsible for import duties and destination charges where legally permitted and disclosed.

5. Production and shipping

The order confirmation or written quote states the expected production and shipment timeframe and any clearly disclosed customer approval requirements. Production time and carrier transit time are separate. Customer-requested changes or delayed approvals may affect scheduling; we will communicate any revised timeframe.

If we cannot ship within the promised timeframe, we will provide legally required delay notices and offer the option to accept the delay or cancel for a prompt refund. If no shipment timeframe is stated, applicable default shipment rules apply. Custom-order and deposit terms do not override legally required cancellation or refund rights for delayed or unfulfilled orders.

You must verify your shipping address before checkout. Address changes require our written confirmation and may require identity verification. Signature delivery may be required for valuable orders. You are responsible for additional reasonable delivery costs caused by an incorrect address you supplied or an unjustified refusal of a correctly fulfilled delivery, where permitted by law.

Contact us promptly about missing, damaged, or incorrect deliveries. We will investigate with the carrier and provide the remedy required by law and the applicable order terms. A carrier delivery scan alone does not automatically waive your rights or establish that a disputed delivery was properly received.

6. Cancellations, returns, and exchanges

For purchases made after this updated policy is published, eligible ready-to-ship jewelry may be returned by requesting a return within seven calendar days of delivery of each item. If the last day falls on a weekend or holiday, the request deadline extends to the next business day. Contact us at bustdowntimepiece@gmail.com before shipping a return so we can provide instructions. Timely requests remain eligible while awaiting our response.

For voluntary change-of-mind returns, items must be unworn, unaltered, undamaged, and returned with their original included packaging, accessories, and grading reports. Customers purchase tracked, insured return shipping. A 15% restocking fee, calculated on the returned item’s purchase price after discounts and excluding tax and shipping, is deducted from an approved change-of-mind refund where legally permitted. Original shipping charges are not refundable for these voluntary returns where legally permitted and disclosed before purchase. No undisclosed additional fee applies.

Custom, personalized, engraved, and specially sized orders are final sale for change-of-mind purposes once production begins, to the extent permitted by law. Cancellation requests before production are evaluated under Section 4; we may retain only reasonable, documented costs for completed work and nonrecoverable materials or commitments, up to the amount paid, and refund the remainder. Cancellation requests are handled directly through our customer service contact; the absence of an online cancellation option does not eliminate legal cancellation rights. The return restocking fee does not apply to unfulfilled-order cancellations.

For defective, incorrect, materially misdescribed items, or our production errors, contact us promptly with your order number and details. We will arrange inspection and the repair, replacement, or refund required by law, covering necessary return shipping and charging no restocking fee for our error. Final-sale labels, the ordinary seven-day window, and voluntary-return condition requirements do not eliminate mandatory legal remedies.

Approved voluntary refunds are issued to the original payment method after inspection, with an itemized explanation of any permitted deductions. We aim to process them within ten business days of receiving the return; legally required shorter deadlines control. Bank or payment-provider posting times vary. Store credit requires your agreement when a monetary refund is legally required. Exchanges are subject to availability and written agreement under our Return and Refund Policy.

Mandatory cooling-off, cancellation, defect, and refund rights remain unaffected. Where a statutory withdrawal right applies, its period and refund rules override the shorter voluntary window and any incompatible fees or exclusions. Our Return and Refund Policy provides the full procedure. Updated terms apply prospectively and do not reduce rights under earlier orders.

7. Sizing, care, and warranties

You are responsible for accurately supplied measurements. Correctly produced pieces requiring changes because of an incorrect customer-provided size may incur resizing and shipping charges, disclosed before work begins. Some designs cannot safely be resized.

Jewelry requires appropriate care. Impact, bending, harsh chemicals, improper cleaning, and unauthorized alterations can damage metals, settings, plating, and stones. Avoid wearing fine jewelry during strenuous activity and have settings inspected periodically.

Any additional commercial warranty is limited to the coverage and period expressly stated in its written terms. We do not provide an additional lifetime repair, replacement, stone-loss, or plating warranty unless expressly offered. Our voluntary warranty may exclude damage caused by misuse, accidental impact, ordinary wear, or third-party work; an exclusion applies only to the extent relevant to the claim and permitted by law. Express product promises and nonwaivable statutory warranties remain in effect.

8. Designs and intellectual property

Our branding, photographs, original designs, drawings, and CAD files remain our property unless a written agreement expressly transfers ownership. Purchasing a finished piece does not transfer the right to reproduce our original design or receive its production files. Exclusive design rights require a separate written agreement.

You retain ownership of artwork you provide. You give us permission to use it as necessary to quote, design, manufacture, and fulfill your order. You represent that you have the necessary rights and permissions. We may refuse designs that appear unlawful or infringe another party’s rights.

We will obtain permission before using your name, likeness, private engraving, or identifying custom-order details in marketing. Unlawful copying or commercial reuse of our protected website content is prohibited.

9. Payment disputes and prohibited conduct

Please contact us about an order problem so we can attempt to resolve it. We may provide payment processors with relevant records, including design approvals, communications, and delivery evidence, subject to our Privacy Policy. Nothing here restricts lawful chargebacks, billing disputes, complaints, or truthful reviews.

You may not use the website for fraud, unauthorized payments, unlawful content, security attacks, or interference with service. We may restrict website access for such conduct without eliminating our obligations on existing orders.

10. Limits on liability

To the fullest extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits or business opportunities, arising from an order or website use. To that same extent, our total liability for a claim relating to an order is limited to the amount paid for that order.

These limits do not exclude or reduce liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot legally be limited, or any nonwaivable consumer right. They do not reduce a refund, repair, replacement, or other remedy required by law. Some jurisdictions do not permit certain limitations; those limitations will not apply there.

11. Privacy and outside services

Our Privacy Policy explains how we handle personal information. Payment processors and other outside services have their own terms where applicable. Their involvement does not eliminate our responsibility to fulfill your order or provide legally required remedies.

12. Disputes and governing law

Please send order concerns to the contact information below, including your order number and a description of the problem. We will attempt to resolve concerns in good faith. This process does not prevent you from using available legal remedies or meeting a legal filing deadline.

These Terms are governed by the laws of [business’s state], excluding its conflict-of-law rules, except where mandatory consumer protections require otherwise. Subject to mandatory jurisdiction rules, disputes may be brought in the state or federal courts with jurisdiction in [county, state]. Nothing requires a consumer to give up a legally protected right to use a court in their home jurisdiction.

13. Changes and general provisions

Updates apply prospectively from the posted effective date. The version accepted when you ordered governs that order unless you expressly agree to a change. If one provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted. Failure to enforce a provision does not waive it.
